Terms of Service

1. Acceptance of Terms

By creating an account, downloading our app, or using BeanGrader in any way, you agree to these Terms and our Privacy Policy. If you do not agree to these terms, you must not use our service. If you are using BeanGrader on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

BeanGrader provides AI-powered coffee bean grading and defect analysis services. Our service includes:

• Image-based analysis of green coffee bean samples using artificial intelligence
• Defect classification aligned with SCA (Specialty Coffee Association) methodology
• Analysis history, record keeping, and PDF report generation
• Credit-based usage system for analysis requests

3. Account Registration

To use BeanGrader, you must create an account. By registering, you agree to: provide accurate, current, and complete information; maintain the security and confidentiality of your login credentials; accept responsibility for all activities that occur under your account; notify us immediately of any unauthorized access. You must be at least 18 years old to create an account.

4. Credits and Payments

BeanGrader uses a credit-based system:

• Credits are required to perform analyses (1 credit = 1 analysis)
• New accounts receive 3 complimentary credits
• Purchased credits do not expire and remain in your account until used
• All credit purchases are processed through our secure payment provider
• Prices are displayed in USD and are subject to change with reasonable notice
• Credits are non-transferable between accounts

5. Refund Policy

Credit purchases are generally final and non-refundable. However, we may consider refund requests in the following circumstances:

• Technical errors that prevented credit delivery
• Duplicate charges due to payment processing issues
• Service unavailability preventing use of purchased credits

Refund requests must be submitted within 14 days of purchase to support@beangrader.com. Approved refunds will be processed to the original payment method within 5-10 business days.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or to violate any laws
• Submit images containing inappropriate, offensive, or illegal content
• Attempt to reverse engineer, decompile, or exploit the service or its algorithms
• Share, sell, or transfer your account credentials to others
• Use bots, scripts, or automated tools to access the service
• Interfere with or disrupt the service, servers, or networks
• Attempt to gain unauthorized access to any part of the service
• Use the service to infringe on intellectual property rights of others

7. Intellectual Property

The BeanGrader name, logo, trademarks, and all software, algorithms, content, designs, and materials are owned by BeanGrader or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our service or intellectual property without prior written permission.

8. User Content

You retain ownership of images and data you submit to BeanGrader. By submitting content, you grant us a limited, non-exclusive license to process, analyze, and temporarily store your content solely for the purpose of providing the service. We do not claim ownership of your content and will not use your images for marketing or other purposes without your explicit consent.

9. AI Analysis Disclaimer

IMPORTANT: BeanGrader uses artificial intelligence to analyze coffee samples. You acknowledge and agree that:

• AI analysis is provided as a pre-screening and educational tool only
• Results may contain errors, inaccuracies, or inconsistencies
• AI analysis does not replace professional grading by certified Q Graders
• Results should not be solely relied upon for commercial decisions, export documentation, or official certification
• We do not guarantee the accuracy, completeness, or reliability of any analysis
• You assume all risk associated with decisions made based on analysis results

10. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions or downtime.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: BeanGrader shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill. Our total cumulative liability for all claims arising from or related to the service shall not exceed the greater of (a) the amount you paid to BeanGrader in the 12 months preceding the claim, or (b) $100 USD.

12. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANALYSIS RESULTS WILL BE ACCURATE OR RELIABLE.

13. Indemnification

You agree to indemnify, defend, and hold harmless BeanGrader, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: your use of the service; your violation of these Terms; your violation of any third-party rights; or any content you submit to the service.

14. Termination

We may suspend or terminate your account immediately, without prior notice, for violation of these Terms or for any reason at our sole discretion. You may delete your account at any time through the app settings. Upon termination: your right to use the service ceases immediately; unused credits are forfeited and non-refundable; we may delete your account data in accordance with our Privacy Policy.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts.

16. Force Majeure

BeanGrader shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, government actions, power outages, internet failures, or pandemics.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeanGrader regarding your use of the service and supersede any prior agreements, communications, or understandings.

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email, through the app, or by posting a notice on our website at least 30 days before the changes take effect. Continued use of the service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the service.
